6.13 Workers' Compensation Policy

Policy

The university provides, at no cost to you, Worker's Compensation coverage for health care services for on-the-job injuries and occupational diseases.

Under the Workers' Compensation law and the National Occupational Safety and Health Act of 1970, it is mandatory that any on the job injury or accident be immediately reported to your supervisor and the Office of Financial Affairs so the proper documentation can be filed for federal inspection. A report is filed with the State of Florida to ensure that any benefits the injured employee may be entitled to are not jeopardized by failure to report. Failure to file within seven (7) days may result in a fine to the university and a loss of benefits to you.

When an injury occurs, you must visit only health care providers designated by Florida Tech's workers' compensation insurance company. If you receive treatment from any provider other than the authorized provider, the employer or the workers' compensation insurance carrier does not cover treatment.

If your workers' compensation primary care physician needs to refer you to a specialist, your adjuster will make the arrangements. You are allowed to make a change of physician within the workers' compensation network only one (1) time during treatment for your work related injury. You would contact your adjuster about provider changes. If you have questions or concerns about your workers' compensation benefits, call the Office of Financial Affairs (321) 674-7297 or your assigned claims adjuster.

Workers' compensation benefits include partial payment of lost wages if a work related injury or illness causes your absence for more than seven (7) calendar days. In cases where the workers' compensation insurance carrier provides payment of wages, it is at the rate of two-thirds of the employee's average gross weekly wage at the time of injury or illness up to the statutorily established cap. When a work related injury or illness results in lost time for more than twenty-one (21) days, the workers' compensation wage benefits are retroactive to the original date of injury.

The university will continue to pay your portion of medical premiums and you will be required to reimburse the university. The Office of Human Resources will provide you with payment arrangements.

Procedure

Non-life threatening on-the-job injury occurs:

  1. Notify your supervisor and then call the Office of Financial Affairs (321)-674-7297. Florida Tech is required by law to report work-related injury or illness to the state within seven (7) days of such occurrence.
  2. You will be directed to an authorized medical provider, insuring that you will not incur expenses.
  3. When you arrive at the medical facility, show your Florida Tech I.D.
    If a non-life threatening on-the-job injury occurs after 5 p.m., please call the Office of Financial Affairs start of the next business day.

If a life threatening or traumatic injury occurs while you are on-the-job, please call 911 immediately.

Please provide the Insurance Specialist with a medical status report after each appointment with the assigned workers' compensation physician.  This will allow the university to determine what position is available within your restrictions.  Our goal is to provide an opportunity for continued employment that is within your restrictions until you are able to return to your regular position.

Employees who are released to light duty must contact the Insurance Specialist immediately.  We will review any restrictions given and implement the process of our Return to Work Program.

Return to Work Program

If you sustain a work-related injury and you are unable to return to work to perform your regular job, we will make every effort to bring you back to work in a temporary modified-duty position however modified-work may not always be available.

We will strive to make modified duty work always available.  If you fail to accept a modified-duty assignment or if you fail to return to work after you have been cleared by your treating physician, you may jeopardize your worker's compensation benefits. Employees working in modified-duty work assignments will be held to the same performance standards and expectations as other employees. The Employee Handbook/Faculty Handbook rules apply.  This program does not create an entitlement or right to a modified duty assignment.  This policy does not alter an employee's at will employment status. Make sure you go to all your scheduled appointments.  Appointments should be scheduled at the end of the work day if possible.  If your appointment is scheduled in the morning, you must return to work after the appointment.

All treating medical providers shall be advised that Florida Tech has a modified duty program and we will need the appropriate restrictions listed to minimize further injury and promote the healing process. Failure to call in or show up for light or modified duty assignment may jeopardize your eligibility for worker's compensation indemnity benefits.

You must provide your supervisor and the insurance specialist with a doctor's note for all absences related to your injury within 24 hours.

Follow the doctor's recommendations in regards to your restrictions, therapies and medications, not only in the workplace but also at home.

National Occupational Safety and Health Act of 1970 (OSHA), Consolidated Omnibus Budget Reconciliation Act (COBRA)
